Her conviction that “under God we’re all equal” was not simply a religious sentiment. It was a claim, grounded in personal experience, that the social categories being used to sort people — to admit some children to good schools and redirect others to substandard ones — did not correspond to any morally meaningful reality. The children being turned away were not less capable, less deserving, or less entitled than the children being admitted. The difference was administrative, not moral. And administrative decisions that violated moral equality should be changed.

## The Science of Harm

The decision to present social scientific testimony about the psychological effects of segregation was one of the most consequential choices David Marcus made in preparing the case. It shifted the evidentiary battleground from a domain where the school districts had prepared defenses — the comparison of physical facilities, the justification of pedagogical need — to a domain they had not anticipated.

The social scientists who testified in Mendez drew on emerging research in developmental psychology and social psychology to argue that children placed in segregated schools received a powerful message about their own worth and their place in the social order. The message was not delivered through explicit instruction; it was structural. When a child is told, through the institutional organization of their education, that they must attend a separate school because of their ancestry, the message received is that their ancestry is a source of inferiority that justifies separation from those who are deemed superior.

Children internalize these messages. Research in the period was beginning to document the ways in which racially segregated environments shaped children’s self-perception, their perceptions of other groups, and their sense of what was possible for children like them. This was the territory that the NAACP was exploring through the work of Kenneth and Mamie Clark, whose doll studies would later be cited in Brown v. Board of Education.
