## The Criminal Proceedings
Phillip and Nancy Garrido were arrested on August 26, 2009, in connection with the kidnapping.
Their path through the criminal justice system was not straightforward. They initially entered not-guilty pleas, and at one point in early 2011, a question arose over grand jury procedures that caused a temporary complication to the plea process. In April 2011, they initially appeared prepared to plead guilty, then did not, before ultimately pleading guilty on April 28, 2011.
Phillip Garrido pleaded guilty to kidnapping and rape by force. He also pleaded guilty to additional counts involving lewd acts captured on video. Nancy Garrido pleaded guilty to kidnapping and rape by force.
Both defendants waived their right to appeal. The plea arrangement was designed in part to spare Jaycee Dugard and her daughters from having to testify at trial.
Sentencing took place on June 2, 2011, at El Dorado County Superior Court in Placerville, California.
Jaycee Dugard did not attend. Her statement was read by her mother. “I refuse to waste another second of my life in your presence,” the statement read, addressing Phillip Garrido directly. “I hated every second of every day for 18 years.” To Nancy Garrido, separately: “There is no God in the universe that would condone your actions.” And about the future: “you do not matter anymore.”
Judge Douglas Phimister described Phillip Garrido as the “poster child” of a sexual predator. He said Garrido had turned Dugard into property and had “reinvented slavery.” He said the Garridos had “gone shopping” for a girl the day they took Dugard, and that Phillip Garrido had used a Taser on her.
